1. Agreement to Terms
By downloading, installing, accessing, or using the Flyfy mobile application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and LukApp ("we", "us", or "our"), the developer of Flyfy.
If you do not agree to these Terms, you must not download, install, or use the App. These Terms supplement, and do not replace, Apple's Standard End User Licence Agreement (EULA) for applications distributed through the App Store. In the event of any conflict between these Terms and Apple's EULA, these Terms shall prevail to the extent permitted by applicable law.
We reserve the right to update these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
2. Description of Service
Flyfy is a premium iOS travel companion application that provides the following features and services:
- Trip planning: Create and manage trips with detailed itineraries including flights, hotels, restaurants, activities, transport, and notes.
- Expense tracking: Record, categorise, and split travel expenses among trip participants with multi-currency support.
- Packing lists: Create and manage personal packing checklists with templates and smart suggestions.
- Document storage: Upload, organise, and share travel documents, booking confirmations, and receipts.
- Travel games: Interactive geography games including capital quizzes, flag guessing, airport quizzes, map tap challenges, flappy airplane, destination roulette, and more.
- Destination discovery: Explore destinations, read travel stories, and find attractions and country information.
- Social features: Add friends, share trips, collaborate on planning, and share live locations during trips.
- Travel passport: Track countries visited, earn achievement badges, and build your travel passport score.
- Cross-device sync: Synchronise personal data across Apple devices via iCloud, and collaborative data via Firebase.
Flyfy is available in three subscription tiers:
- Free: Core features including trip planning, expense tracking, packing lists, games, and discovery. No collaboration capabilities.
- Pro ($4.99/month or $29.99/year, with a 1-week free trial): All Free features plus trip sharing with up to 10 collaborators per trip, shared document storage (500 MB per trip), shared notes, and expense splitting.
- Business ($19.99/month or $149.99/year, with a 2-week free trial): All Pro features with unlimited collaborators per trip and expanded document storage (2 GB per trip).
We reserve the right to modify, suspend, or discontinue any feature or aspect of the App at any time, with or without notice. We will use reasonable efforts to provide advance notice of material changes.
3. User Accounts
3.1 Account Creation
To use Flyfy, you must create an account using Sign in with Apple. This is the sole authentication method supported by the App. By creating an account, you represent that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction) and have the legal capacity to agree to these Terms.
3.2 Account Responsibilities
You are responsible for:
- Maintaining the security of your Apple ID and the devices used to access the App.
- All activities that occur under your account.
- Ensuring the accuracy of any information you provide through the App.
- Complying with all applicable laws and regulations when using the App.
3.3 Account Termination
We may suspend or terminate your account if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or used the App in a manner harmful to other users or to LukApp. We will make reasonable efforts to notify you before or at the time of suspension or termination.
You may delete your account at any time through the App (Profile > Settings > Delete Account). Upon account deletion, your data will be processed as described in our Privacy Policy.
4. Acceptable Use
4.1 Prohibited Conduct
When using Flyfy, you agree not to:
- Upload, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Harass, bully, intimidate, or threaten other users.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any portion of the App, other users' accounts, or any systems or networks connected to the App.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Use automated tools, bots, or scripts to interact with the App.
- Create multiple accounts for deceptive or abusive purposes.
- Use the App for any commercial purpose not expressly authorised by these Terms.
- Share inappropriate, offensive, or illegal content in shared trips, notes, or documents.
- Attempt to circumvent any subscription restrictions, content filtering, or other security measures of the App.
- Interfere with or disrupt the App or the servers and networks connected to the App.
4.2 User-Generated Content
You retain ownership of all content you create within the App, including trip plans, itinerary items, notes, documents, and expenses ("User Content"). By using the App's collaborative features, you grant LukApp a limited, non-exclusive, worldwide, royalty-free licence to store, process, transmit, and display your User Content solely as necessary to provide the App's services, including syncing data across devices and enabling collaboration with other users.
You are solely responsible for your User Content and represent that you have all necessary rights to share any content you upload or create in the App.
Zero-tolerance policy for objectionable content. LukApp operates a zero-tolerance policy for objectionable, abusive, or illegal User Content and for abusive user behaviour within shared trips and collaborative features. You agree not to create, upload, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, pornographic, or otherwise objectionable.
4.3 Content Reporting and Moderation
If you encounter content or behaviour that violates these Terms, you can report it directly within the App using the Report function available on user profiles and shared content. Reports are reviewed by our team within 24 hours.
Upon receiving a report, LukApp may:
- Remove the reported content.
- Temporarily or permanently suspend the offending account.
- Restrict the offending user's access to collaboration features.
Users who are the subject of a report will be notified of any action taken. Repeated violations will result in permanent account suspension.
You can also block individual users directly from the App (Profile > Friends > long-press a user > Block). Blocked users' content will be immediately hidden from your view, and they will be unable to invite you to new shared trips.
If you believe content has been wrongly removed or your account has been wrongly restricted, you may appeal by contacting support@lukapp.ge within 14 days of the action.
LukApp reserves the right to remove any content and suspend any account at its sole discretion to maintain a safe environment for all users.
5. Intellectual Property
The Flyfy application, including its design, code, user interface, graphics, icons, travel games, quiz content, badge designs, animations, and all other creative elements, is owned by LukApp and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, LukApp grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on Apple devices that you own or control, for personal, non-commercial purposes.
You may not:
- Copy, modify, distribute, sell, or lease any part of the App.
- Create derivative works based on the App.
- Remove, alter, or obscure any proprietary notices in the App.
- Use the App's name, logo, or branding without prior written consent from LukApp.
- Extract or reuse any data, content, or materials from the App for purposes unrelated to your personal use of the App.
6. In-App Purchases and Subscriptions
All in-app purchases and subscriptions are managed through the Apple App Store. By making a purchase, you also agree to Apple's payment terms and conditions.
- Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. The renewal charge will be applied within 24 hours prior to the end of the current period.
- Management: You can manage and cancel your subscriptions through your Apple ID account settings in the App Store or iOS Settings.
- Refunds: All refund requests must be directed to Apple, as they process all payments. LukApp does not handle payment processing or refunds directly.
- Price changes: We may change subscription prices from time to time. Apple will notify you of any price changes, and you will have the opportunity to cancel before the new price takes effect.
- Subscription lapse: If your subscription expires or is cancelled, you will retain access to Free tier features. Shared trip data will become read-only. Your data is preserved and full access is restored upon resubscription.
7. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Flyfy, you consent to the data practices described in the Privacy Policy.
8. CloudKit and Data Sync
Flyfy uses Apple's CloudKit to synchronise your personal trip data across your Apple devices, and Google Firebase to synchronise collaborative trip data among trip participants.
- iCloud dependency: CloudKit synchronisation requires an active iCloud account with available storage. We are not responsible for any data loss, sync delays, or service interruptions caused by iCloud outages, storage limitations, or account issues.
- Firebase dependency: Collaborative features require an active internet connection. Firebase services include offline persistence; data entered offline will sync when connectivity is restored.
- Account responsibility: You are responsible for maintaining the security of your iCloud account and managing your iCloud storage.
- Data accuracy: We use conflict resolution mechanisms to handle concurrent edits, but in rare cases, data conflicts may occur. We are not liable for data loss resulting from sync conflicts.
9. Third-Party Services
Flyfy integrates with the following third-party services:
- Apple: CloudKit (data sync), Sign in with Apple (authentication), StoreKit (subscriptions and purchases), APNs (notification delivery).
- Google Firebase: Firestore (collaborative data), Realtime Database (live location), Firebase Storage (shared documents), Cloud Functions (server-side logic), Cloud Messaging (push notifications).
These third-party services are governed by their own terms and privacy policies. We encourage you to review the terms of service and privacy policies of Apple and Google. LukApp is not responsible for the availability, accuracy, or content of third-party services, and shall not be liable for any damage or loss arising from your use of or reliance on such services.
The App may also contain links to external websites or resources. We do not endorse and are not responsible for any third-party content or services accessible through these links.
10. Disclaimers and Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, LukApp disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the App will meet your requirements or expectations.
- Warranties that the App will be uninterrupted, timely, secure, or error-free.
- Warranties regarding the accuracy, reliability, or completeness of any travel information, destination data, game content, or other information provided through the App.
- Warranties that any defects in the App will be corrected.
Travel information, country data, and destination content provided in the App are for informational purposes only and should not be relied upon as the sole basis for travel decisions. Always verify travel requirements, visa regulations, and safety information through official government sources.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUKAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, resulting from:
- Your use of or inability to use the App.
- Any unauthorised access to or alteration of your data or transmissions.
- Any third-party conduct or content within the App.
- Loss of data due to sync failures, iCloud outages, or Firebase service interruptions.
- Any other matter relating to the App.
In no event shall LukApp's total aggregate liability to you for all claims arising from or related to the App exceed the greater of (a) the total amount you have paid to LukApp through in-app purchases in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless LukApp and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the App.
- Your User Content.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your violation of any rights of a third party.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of these Terms.
- Include a notice in the App's update release notes.
- Provide in-app notification for significant changes where practicable.
Your continued use of the App after any modification to these Terms constitutes your acceptance of the modified Terms. If you do not agree with any modification, you should discontinue use of the App and delete your account.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Georgia (the country), without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia, unless otherwise required by applicable consumer protection laws in your jurisdiction.
If you are an international user, you acknowledge that local consumer protection laws may provide additional rights that cannot be waived by contract. Nothing in these Terms is intended to override any mandatory consumer protection rights applicable in your jurisdiction.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the original provision.
16. Entire Agreement
These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and LukApp regarding your use of the App. These Terms supersede any prior agreements, understandings, or arrangements between you and LukApp, whether written or oral, relating to the App.
